Terms & Conditions
This is an agreement (this “Agreement”) between Datamyx LLC, a Delaware limited liability company (“Company”) and you. The act of accessing the Intelidata Express system (the “System”) indicates that you understand and agree to the terms and conditions set forth herein. The services and data (the “Services”) accessible through the System may only be used in accordance with the terms of a master agreement between Company and you or a third party (as applicable, the “Authorized Party”) that has authorized you to access the Services in accordance with such master agreement (a “Master Agreement”). If you are not an Authorized Party, you may not use the System. Any use by you of the System or the Services must be conducted in accordance with the terms and conditions set forth in the applicable Master Agreement. All of the terms and conditions in the applicable Master Agreement relating to the use of the Services or the System are incorporated herein by reference and any breach of such terms by you shall be deemed a breach of this Agreement. You agree that Company may exercise all rights and remedies granted to Company under the Master Agreement or applicable law for any breach by you of the terms and conditions of the Master Agreement applicable to the use of the Services and the System. Nothing in this Agreement limits any of the terms and conditions in the applicable Master Agreement. If there is any conflict between the terms of this Agreement and the Master Agreement, the terms of the Master Agreement shall govern. If you do not wish to accept the terms and conditions of this Agreement or if you have any questions, please feel free to contact the Authorized Party’s Company sales representative or Client Services at firstname.lastname@example.org. YOU ACKNOWLEDGE THAT THE SERVICES THAT YOU RECEIVE THROUGH THE SYSTEM MAY INCLUDE DATA, THE USE OF WHICH MAY BE HIGHLY REGULATED AND RESTRICTED, INCLUDING CONSUMER CREDIT DATA. YOU AGREE TO COMPLY WITH ALL FEDERAL, STATE AND LOCAL LAWS, RULES AND REGULATIONS APPLICABLE TO YOUR RECEIPT AND USE OF THE SERVICES. WITHOUT LIMITING THE FOREGOING, IF YOU RECEIVE PRE-SCREENED CONSUMER CREDIT DATA AS PART OF THE SERVICES, YOU AGREE TO USE SUCH SERVICES IN COMPLIANCE WITH THE FAIR CREDIT REPORTING ACT, 15 U.S.C. 1681, AS AMENDED (“FCRA”), AND THAT EACH CONSUMER LISTED IN SUCH DATA WILL RECEIVE A “FIRM OFFER OF CREDIT OR INSURANCE” AS DEFINED IN FCRA. CLIENT CERTIFIES THAT IN CONNECTION WITH ANY PROJECT LEVERAGING CONSUMER REPORTING AGENCY DATA THAT IT WILL ORDER CONSUMER REPORTS, AS DEFINED BY THE FEDERAL FAIR CREDIT REPORTING ACT, 15 U.S.C. §1681 ET. SEQ., AS AMENDED (THE "FCRA"), ONLY WHEN CLIENT INTENDS TO USE THE CONSUMER REPORT IN ACCORDANCE WITH THE FCRA AND ALL STATE LAW FCRA COUNTERPARTS AND FOR THE FCRA PERMISSIBLE PURPOSE OF EXTENDING EACH CONSUMER A FIRM OFFER OF CREDIT OR INSURANCE (AS THAT TERM IS DEFINED IN THE FCRA). CLIENT FURTHER CERTIFIES THAT IT WILL USE EACH CONSUMER REPORT ORDERED FROM CONSUMER REPORTING AGENCY FOR THE FOREGOING PURPOSE AND FOR NO OTHER PURPOSE AND THAT IT WILL NOT SHARE WITH, OR PROVIDE TO, ANY THIRD PARTY SUCH CONSUMER REPORTS, EXCEPT AS OTHERWISE PERMITTED BY CONSUMER REPORTING AGENCY. You acknowledge that the System is a secure computing platform for the exclusive use of Authorized Party’s, as determined and approved by Company in its sole discretion. All users of the System from your organization must be disclosed to Company in writing prior to their use of the System or Services. All of your users must have an individual and unique access code. Access codes may not be shared or distributed under any circumstances without prior written permission from Company. Company reserves the right to administer security measures to protect its security and the security of the System and Services in its sole discretion. You must take all necessary steps to maintain the confidentiality and security of all access codes, documentation and associated materials, and the Services. Any known security breach, loss, or unauthorized disclosure of information must be reported immediately to Client Services at email@example.com
